Terms of Service

1. Acceptance of Terms

By accessing or using Our Time Away (“the Service”), including the mobile application, web application, and website at ourtimeaway.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Our Time Away provides vacation journaling, group trip coordination, trip narratives, memory book creation, social media content sharing, and merchandise ordering. The core app features are provided free of charge. Physical merchandise is sold at listed prices plus shipping.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must provide accurate information and be at least 13 years old (or the minimum age in your jurisdiction).

4. User Content

You retain ownership of all content you create or upload (“User Content”), including journal entries, photos, and trip data. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service (including content processing, book generation, and merchandise creation).

You are responsible for the content you upload. Do not upload content that is illegal, infringing, or harmful.

5. AI-Generated Content

The Service uses artificial intelligence (AI) to generate journal prompts, trip narratives, photo captions, and other content based on your trip data. AI-generated content is provided “as is” and may contain inaccuracies, hallucinations, or errors. You are solely responsible for reviewing and editing AI-generated content before sharing, printing, or ordering physical products that include it.

Opt-out: You may disable AI-generated content at any time in Settings → Privacy & Data → AI-generated Content. When disabled, the app uses standard (non-personalized) prompts and does not generate AI narratives or captions.

Ownership: You retain ownership of AI-generated content derived from your trip data. Our AI providers do not claim ownership of, or use, your inputs or the generated outputs to train their models.

6. Merchandise Orders

Merchandise (photo books, mugs, prints, canvas) is fulfilled by Gelato, a third-party print-on-demand provider. Prices are listed in USD and include the product cost. Shipping and applicable taxes are calculated at checkout. Orders are non-refundable except for defective or damaged items. For issues with your order, contact us at [email protected].

7. Payments

Payments are processed by Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms of service.

8. Public Trip Pages

You may choose to enable a public trip page, which creates a shareable URL displaying your trip summary, photos, and activities. Public pages use unguessable URLs and are not indexed by search engines. You can disable public pages at any time.

9. Group Trips

When you join a group trip, other members can see the shared itinerary. Journal entries are private by default — you choose what to add to the group. Trip creators/admins can manage group membership and trip settings.

10. Account Access by Staff

Authorized Our Time Away personnel may access your account for customer support, troubleshooting, security investigations, or to resolve issues you report. When staff access your account, they can view your data and take actions as if they were you. All staff access is logged and subject to internal policies. Staff will not modify your data without your knowledge unless required for security, legal compliance, or to protect the rights and safety of our users.

11. Termination

You may delete your account at any time from Settings. We may suspend or terminate your account if you violate these terms. Upon deletion, your personal data will be permanently removed within 30 days.

12. Limitation of Liability

The Service is provided “as is” without warranties of any kind. We are not liable for data loss, service interruptions, or damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
