Terms of Service

1. Acceptance of Terms

By accessing or using Our Time Away (“the Service”), including the mobile application, web application, and website at ourtimeaway.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Our Time Away provides vacation journaling, group trip coordination, trip narratives, memory book creation, social media content sharing, and keepsake ordering. The core app features are provided free of charge. Physical keepsakes are sold at listed prices plus shipping.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials. You must provide accurate information and be at least 13 years old (or the minimum age in your jurisdiction).

4. User Content

You retain ownership of all content you create or upload (“User Content”), including journal entries, photos, and trip data. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service (including content processing, book generation, and keepsake creation).

You are responsible for the content you upload. Do not upload content that is illegal, infringing, or harmful.

5. AI-Generated Content

The Service uses artificial intelligence (AI) to generate journal prompts, trip narratives, photo captions, and other content based on your trip data. AI-generated content is provided “as is” and may contain inaccuracies, hallucinations, or errors. You are solely responsible for reviewing and editing AI-generated content before sharing, printing, or ordering physical products that include it.

Opt-out: You may disable AI-generated content at any time in Settings → Privacy & Data → AI-generated Content. When disabled, the app uses standard (non-personalized) prompts and does not generate AI narratives or captions.

Ownership: You retain ownership of AI-generated content derived from your trip data. Our AI providers do not claim ownership of, or use, your inputs or the generated outputs to train their models.

6. Keepsake Orders

Keepsakes are fulfilled by third-party print-on-demand providers: photo books by Prodigi, and mugs, prints and canvas by Gelato. Prices are listed in USD and include the product cost. Shipping and applicable taxes are calculated at checkout. Orders are non-refundable except for defective or damaged items. For issues with your order, contact us at [email protected].

7. Payments

Payments are processed by Stripe. We do not store your credit card information. By making a purchase, you agree to Stripe's terms of service.

8. Group Trips

When you join a group trip, other travelers can see the shared itinerary. Journal entries and photos are private by default — you choose what to add to the group. The trip organizer can manage who is on the trip and change trip settings.

9. Account Access by Staff

Authorized Our Time Away personnel may access your account for customer support, troubleshooting, security investigations, or to resolve issues you report. When staff access your account, they can view your data and take actions as if they were you. All staff access is logged and subject to internal policies. Staff will not modify your data without your knowledge unless required for security, legal compliance, or to protect the rights and safety of our users.

10. Termination

You may delete your account at any time from Settings. We may suspend or terminate your account if you violate these terms. Upon deletion, your personal data will be permanently removed within 30 days.

11. Prohibited Content & Removal Requests

You may not upload content that is unlawful, or that shows another person in an intimate context without their consent — including computer-generated or altered images made to look like a real person. We remove such content when we learn of it and may suspend the account responsible.

Travelers can report a photo or journal entry from inside the app using the Report control on the item itself.

If an intimate image of you has been shared without your consent, you can ask us to remove it using our content removal form. You do not need an account to use it. We act on valid requests within 48 hours, make reasonable efforts to remove identical copies, and give you a reference number to track the request.

Any traveler on a trip can remove any photo from that trip — not just photos they added. Removing a photo takes it out of the trip for everyone, including from books and keepsakes that haven't been ordered yet. It does not affect the copy on anyone's own device. The trip organizer can also remove a traveler from the trip.

12. Not a Backup or Storage Service

Our Time Away is not a backup or storage service — keep your own copies of your photos. You upload photos so we can build your trip and your keepsakes.

13. Limitation of Liability

The Service is provided “as is” without warranties of any kind. We are not liable for data loss, service interruptions, or damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
